Colorado State University-Pueblo administrators accused student-athlete Grant Neal of rape. Except, there was no rape. There wasn’t even an accuser. Grant Neal carried on a secret relationship with one of the athletic trainers. When the affair was discovered, he was reported to the administration who suspended Neal.
The athletic trainer told school administrators that their relationship was completely consensual. The university responded by suspending Neal, denying him due process, and eventually expelling him.
Neal filed suit against the University, the Department of Education, Secretary John B. King, and Assistant Secretary Catherine Lhamon. His suit contends that rules promulgated under the 2011 Administrative Procedure Act violated his civil rights.
